Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mail Just Works service ("Service") operated by Work Six Ltd, a company registered in England and Wales ("Company", "we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Mail Just Works is an outbound email delivery service. It accepts email messages originating from your websites via our API and delivers them to the intended recipients on your behalf.

2. Eligibility and Accounts

The Service is available to individuals and businesses. You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete registration information and to update it promptly if it changes.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to anti-spam legislation such as the UK Privacy and Electronic Communications Regulations, the EU ePrivacy Directive, the US CAN-SPAM Act, and any other relevant legislation in the jurisdictions where your recipients are located. You must not use the Service to:

  1. Send unsolicited bulk or commercial email ("spam").
  2. Send messages containing malware, phishing content, or deceptive headers.
  3. Transmit content that is unlawful, defamatory, obscene, or infringes any third party's intellectual property rights.
  4. Harvest email addresses or use the Service for any form of list-bombing or denial-of-service activity.
  5. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate your account without notice if we reasonably believe you have violated this section.

4. Fees and Payment

The Service is offered on both annual subscription and pay-as-you-go (usage-based) plans. Current pricing is published on our website. All fees are quoted exclusive of VAT unless otherwise stated. Payments are processed by Stripe. By providing payment details you authorise us (via Stripe) to charge the applicable fees. Subscription fees and usage-based fees are billed in advance. If payment fails, we may suspend your access until the outstanding balance is settled.

5. Email Content and Your Data

You retain all rights in the content of the emails you send through the Service ("Your Content"). You grant us a limited licence to process, transmit, and temporarily store Your Content solely for the purpose of providing the Service. We do not sell, share, or use Your Content for any purpose other than delivering it as instructed by you, except as required by law.

6. Service Levels and Availability

We use commercially reasonable efforts to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance where practicable. We are not liable for any delay or failure in email delivery caused by factors outside our reasonable control, including recipient mail server behaviour, network congestion, or third-party infrastructure outages.

7. Third-Party Sub-Processors

We use third-party infrastructure providers (sub-processors) to help deliver and temporarily store email. These sub-processors are bound by contractual obligations to protect your data. A list of current sub-processors is available on request. We will notify you of any material changes to our sub-processor list.

8. Intellectual Property

All rights, title, and interest in the Service (including its software, design, documentation, trademarks, and branding) remain with Work Six Ltd. Nothing in these Terms grants you any rights in our intellectual property except the limited right to use the Service as described herein.

9. Limitation of Liability

To the maximum extent permitted by law, the Company's total aggregate liability to you for any and all claims arising out of or relating to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, however caused. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

10. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, and employees from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or any allegation that Your Content or your use of the Service infringes the rights of a third party or violates applicable law.

11. Suspension and Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms or if required to do so by law. On termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, subject to any legal obligation to retain it.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
